• An independent agency to maintain Assisted Reproductive Technology (ART) banks. These banks will recruit the surrogate mothers in India instead of the clinics.  That will give the mothers more freedom to negotiate their own fees.
• A limit of five surrogate pregnancies per mother.
• An age limit of 35 years for the surrogate mother.
• A prior guarantee that the home country of the commissioning parents will accept the child as theirs once it is born.

Research the qualifications of the IVF doctors in India and their clinics, so that you know the ones you want to work with. Also, research the laws regarding surrogacy in your country or state  on the following:

• Will you be legally recognized as a parent or parents of the child?
• Will your child be recognized as yours and be issued a passport to return to your home country?
• Will you have to go through adoption proceedings before the child will be considered yours?

Some countries require a DNA test to prove that the child is related to one of the commissioning parents. Some countries require consent from the birth parent (the surrogate mother) before travel with another parent (a commissioning parent) is allowed.

An agreement covering all these issues signed by all the participants is highly advised.  It is also advisable for the commissioning parents to hire a lawyer in their home country who can work with a lawyer in India to draft the agreement.
